Goava is a company focused on digital marketing and we offer data driven marketing solutions to improve your business to business (B2B) sales.
This Privacy Notice applies to the business of Goava Sales Intelligence AB, reg no . 559081-1518, Saltmätargatan 9, SE 113 59 Stockholm and its website www.goava.com, or any other domain as instructed. In this document you can learn about why we use personal data and how we manage it.
2.1 We get your personal data in three different ways: if you provide us with it, when we collect it from you or through third parties.
2.2 Personal data you provide us with. Data you provide us with includes: Personal identification information (Name, company, email address). We only do this if you submit a form on our website. The form can be for a whitepaper, webinar, or other information that we need your email to be able to send to you.
2.3 Personal data we collect from you. We collect contact details of company representatives published online, to create contact lists which is a part of our services. We only keep contact details that are currently published.
2.4 Personal data we get from third parties. Such as public information from e.g. governmental institutions such as Swedish Bolagsverket.
3.1 Our main purpose for using your personal data is to provide our customers with our products and services and taking steps to enter into contract. For more details see here:
3.1.1 Provide our customers with our products and services. Maintaining our products and services relevant in content by compiling publicly available information on decisions makers in various industries. We will collect contact details of decision makers available on companies’ and organisations’ websites. We collect and use this personal data as a part of our services and products in order to improve such companies sales. We also compile and distribute newsletter with news monitoring of relevant and current affairs. For more information about our news monitoring service, see under section X.
Legal Basis: We use publicly available contact information as necessary to compile current and correct lists of decision makers in various industries. We base our use of such data on our legitimate interest to be able to provide our services to our customers, an interest that is shared with our customers and with the decisions makers whose data is made available. With regard to the news monitoring service in Sweden we rely on our certification of publication.
3.1.2 Taking steps to enter into contract. When you register online to book a demo or contact our sales people by phone, chat or email to purchase or products and services. If you register on website, we will process information including [describe the personal data].
Legal Basis: We use the information you provide to us as necessary to act on your inquiry (legitimate interest) and/or to take necessary steps to enter into an agreement with you (contract).
3.1.3 Communicating with us. If you contact us with inquires or other communication, we will process your personal data such as [e-mail and name, and other personal data you provide int your communication with us] to resolve your questions.

3.1.4 Marketing. Goava would like to send you information about products and services of ours that we think you might like, including but not limited to offering you a demo, invite you to webinars and other marketing activities. If you have signed up to receive marketing, you may always opt out at a later date. You have the right at any time to ask Goava to refrain from contacting you for marketing purposes by contacting opt-out@goava.com
Legal basis: Our legal basis is either your consent to receive marketing (under the e-privacy directive) or if you are a in a customer relationship, our legitimate interest to send you marketing about similar services.
3.1.5 Receive marketing offers from our partners. If you have agreed, we may share your contact information with our partners in relation to a webinar or an event. If you have agreed to receive promotions from our partners, you may always opt out at a later date. You have the right at any time to ask Goava to refrain from sharing your information to our partners by contacting support@goava.com.
Legal basis: Our legal basis is your consent to receive marketing from our partners (under e-privacy directive).
3.1.6 Legal obligations: We may use your information to fulfil legal requirements, binding regulations, judgments or government decisions, e.g. the Accounting Act.
Legal basis: The processing is based on our obligation to fulfil our legal obligations and the processing is required by law.
4.1 Goava will, from time to time, share your personal data with our affiliates or other companies performing services for us. If you agree, Goava will share your data with our partner companies so that they may offer you their products and services. This applies to webinar speakers.
4.2 In case we share your personal data with our affiliates or other companies, we have ensured that these recipients of your data comply with our data protection requirements. Also, they are not allowed to process personal data for other purposes than those stated by Goava in this notice.
4.3 Goava may also, under certain circumstances, share your personal data if we deem it necessary to:
a) comply with the law, legal proceedings, government decisions or court orders and provide information to the police and other competent authorities;
b) be able to fulfil our agreements;
c) protect our customers, for example to prevent attempted fraud or spam, or to facilitate the prevention of death or serious injury;
d) manage and maintain the security of our service, including preventing or stopping an attack on our systems or networks;
e) a potential investor or buyer (and its agents and advisers) in connection with any proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Privacy Notice; or
f) protect the rights or property of ours. If we receive information that someone is using our services to sell stolen property that belongs to us, we will not investigate a customer's private content ourselves, but leave the matter to a police authority.
5.1 Goava would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following rights:
5.1.1 The right to access. You have the right to request us for copies of the personal data we process about you.
5.1.2 The right to rectification. You have the right to request that Goava correct any information you believe is inaccurate. You also have the right to request your data to complete information you believe is incomplete.
5.1.3 The right to erasure. You have the right to request that Goava erase your personal data, under certain conditions.
5.1.4 The right to restrict processing. You have the right to request that Goava restrict the processing of your personal data, under certain conditions.
5.1.5 The right to object to processing. You have the right to object to Goava's processing of your personal data, under certain conditions.
5.1.6 The right to data portability. You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
5.1.7 Profiling and automated decision-making. You have the right to object to decisions made through automated processing, including profiling.

5.3 Should you wish to report a complaint or if you feel that Goava has not addressed your concern satisfactorily, you have the right to lodge a complaint to the Swedish Authority for Privacy Protection (“IMY”), www.imy.se.
6.1 To protect your personal data and the privacy of our users, we have implemented physical, technical and organizational security measures.
6.2 Personal data managed by Goava is stored and processed in the region in which you live, in Sweden or in other European countries where we, our business partners or suppliers are active. We take steps to ensure that the information we collect in accordance with this Privacy Notice is dealt with in accordance with the provisions of this Notice and in accordance with applicable laws where the information is available.
6.3 When required or appropriate and feasible, we obtain written assurances from third parties that may access your data that they will protect the data with safeguards designed to provide a level of protection equivalent to that adopted by Goava. If we were to transfer your personal data to third countries, i.e. countries outside the EU / EEA, we will enter into agreements and take other measures in accordance with applicable legal requirements.
6.4 To protect the privacy of your personal information, we maintain both technical and organisational safeguards, and we update and test our security regularly. However, no information system can be completely secure. Hence, we cannot guarantee the absolute security of your information. Moreover, we are not responsible for the security of information you transmit to us over networks that we do not control, including the Internet and wireless networks.
7.1 Goava will keep your personal data for as long as necessary for the purpose they were collected. We use the following criteria’s the determine how long we store your personal data:
7.1.1 How long is the personal data necessary to provide our services to you?
That includes, updates on our service and website, managing your account, administer necessary business and accounting information and to protect our systems. This is the general rule we use to decide how long we will retain your personal data, if any of the exemptions below are not applicable.
7.1.2 Do we process any sensitive personal data?
No. We only use publicly available contact information about decisions makers, from the organisations’ websites. In our news service, we limit our processing to contact information and brand names.
7.1.3 Have you given your consent to the processing?
When you have given your consent to the processing of your data, we will keep it for a longer time period in line with the information in the request for consent.
7.1.4 Do we have legal, contractual or similar obligations to store the data?
Such situations may, for example, refer to mandatory legislation on the storage of personal data, for example for accounting purposes or according to the law on limitation period, provisions to store data that are relevant to investigations or data that must be retained in order to resolve a dispute.
7.2 If we process your data based on consent, you may withdraw your consent at any time.
8.1 Goava aim to process and use processors that store your personal data within the EU/EEA region. If we need to transfer your data to a third country, we will comply with art. 46 of the GDPR, including but not limited to the use of the EU Commission SCCs. We monitor the legal development regarding data transfers between EU-US after the CJEU Schrems II-decision, and we will use appropriate measures to implement the safety measures recommended.
8.2 In order to protect your personal data, we use technical and organisational measures which we review and update regularly.
9.1 Aggregated data and Third Party websites
The Goava website contains links to other websites. Our privacy policy applies only to our website, so if you click on a link to another website, Goava is not responsible for the processing of personal data by any third parties. We encourage you to read the respective privacy policy of the websites you are re-directed to.
10.1 We reserve the right to make changes and updates to this Privacy Notice, When we make such updates or changes, the “Last Revised”-date at the top of this Privacy Notice will be updated as well. The changes made will be described under the section “Change History”. If we make any significant changes, we will notify you on our website or by e-mail. Our Company keeps its privacy policy under regular review.
